Procedures for Registration and Renewal of Overseas Manufacturing Facilities

Legal Matters:

In accordance with Article 5 (Registration of Overseas Manufacturing Facilities) of the "Special Act on the Safety Management of Imported Food," anyone who intends to import food into the country or install or operate overseas manufacturing facilities must register the overseas manufacturing facilities with the Minister of Food and Drug Safety before importing.

 

Basis of Legislation:

  • Article 5 Paragraph 1, 2, and 6 of the Special Act on the Safety Management of Imported Food
  • Article 2 Paragraph 1, 3, and 4 of the Enforcement Regulations of the Special Act on the Safety Management of Imported Food

1. Application for Registration of Overseas Manufacturing Facilities

1) Applicant:

  • The installer and operator of the overseas manufacturing facility (in the exporting country) or the importer (in the domestic market) can apply.

2) Application Method:

  • Application form for registration, change registration, or extension of validity period of overseas manufacturing facilities (Annex No. 1 Form of the Enforcement Regulations of the Special Act on the Safety Management of Imported Food)

4) Processing Period:

  • 3 days

5) Notes on Registration:

  • Overseas manufacturing facilities must register actual manufacturing or processing facilities, not export or sales offices.
  • If the import food is livestock products, the registration must be applied through the government of the exporting country as an overseas workplace, not as an overseas manufacturing facility (e.g., meat and meat products, raw milk and dairy products, egg products, etc.).
  • In the case of agreed countries for fisheries products, registration must be applied through the country.

  • Confirmation Form (A confirmation form of registered information.docx)
  • Proof documents issued by the government of the exporting country that specify the information of the factory (name of the manufacturing facility, address, date of issuance, etc.)
    • Proof that the facility is an actual manufacturing or processing facility issued by the government of the exporting country
    • If the document is not in English, a certified English translation is required
  • Proof documents of food safety management systems such as GFSI certificate, GMP, HACCP, ISO, etc.
  • Additional documents proving the manufacturing facility (if needed)

2. Renewal of Registration of Overseas Manufacturing Facilities

1) Validity Period:

  • 2 years
    • After the validity period expires, products manufactured at the facility cannot be imported domestically.

2) Renewal Application:

  • It can be applied for renewal online from 2 months before the expiration date.

3. Change Registration of Overseas Manufacturing Facilities

When changes occur, change registration must be performed:

  • Name of the overseas manufacturing facility
  • Location of the overseas manufacturing facility (including changes in the name of the administrative district)
  • Type of business (food, food additives, appliances and packaging manufacturing processing, etc.)
